The E-zie application ( "E-zie") is operated by Digital HQ, a private limited company, registered under company number 0694.926.608 ( "DigitalHQ" ). E-zie aims to facilitate the services and operation of DigitalHQ.

In this privacy statement, DigitalHQ informs you about the use of your personal data on E-zie ( "Privacy Statement" ). DigitalHQ is regarded as a "controller" for certain processing activities ( see article 3.2) and for others as "processor" ( see article 3.1).

DigitalHQ does not take this responsibility lightly. DigitalHQ therefore handles your personal data in a responsible manner. Your personal data will be carefully processed and secured in accordance with applicable regulations, such as the general data protection regulation of April 27, 2016 (also referred to as "GDPR") and the law on the protection of natural persons with regard to the processing of personal data of 30 July 2018. In particular, the principles of privacy by design and data minimization are strictly adhered to.

Does DigitalHQ process personal data?

You can use E-Zie as a customer (employer), or as an employee or visitor at the invitation of this customer, or as a third visitor.

In order to make optimal use of our services, an account must be created on E-zie for each user. This account requires registration of your name, email address , password , phone number and company name, among other things.

In addition, personal data is processed according to the services used. This processing is necessary for the proper functioning of the service. The services that DigitalHQ offers via E-zie include: [DLAP1]

Why does DigitalHQ process this data?

Depending on the capacity in which you rely on the services of DigitalHQ (as an employee of one of our customers (your employer), visitor at the invitation of one of our customers, or a third party, DigitalHQ acts as "processor" or as " controller ".

DigitalHQ as a processor for the service to the customer

If you are an employee or visitor at the invitation of one of our customers, and use the services within E-zie, we will process your personal data to provide the services that we make available at the request and expense of your employer.

Depending on the services chosen by the employer ( see article 2) DigitalHQ will process certain personal data when this service is used via E-zie.

For a detailed overview, please refer to the applicable privacy statement of your employer. After all, these data are processed by DigitalHQ on behalf of and at the expense of the employer, who determines the purpose and means of the processing activities. DigitalHQ therefore limits itself to processing this personal data in accordance with and within the bounds of the concluded processing agreement with your employer.

DigitalHQ therefore acts here as a processor, and not as a controller. We therefore refer to the applicable privacy statement of your employer.

DigitalHQ as controller of your personal data

  • Billing purposes for the customer

If you are an employee or visitor at the invitation of one of our customers, and use the services via E-zie, we process personal data that is necessary to prepare the invoicing. We process this data that allows us to know which services you use and with what frequency, so that we can map out how much your employer has to pay for the services used.

These data may, depending on the services you use ( see article 2), for example name, email address and location. For this purpose, we only process those personal data that are strictly necessary to prepare the invoicing in order to be able to fulfill our contractual obligations towards our customer (your employer).

This processing is therefore necessary for the representation of our legitimate interest, namely in order to be able to fulfill our contractual obligations towards your employer. In doing so, we ensure that your fundamental rights and freedoms are respected.

  • Services towards third parties

If you as a third party, ie without being connected to one of our customers, use our services through our E-zie application, a direct contract is concluded between you and DigitalHQ.

In this context, we will then process certain personal data, depending on the services you use ( see article 2), in order to be able to provide this service. This processing of personal data is therefore necessary to perform a contract concluded with you.

  • Analysis for service improvement

As soon as you use our Application (in whatever capacity), we will collect certain personal data (usage data) with a view to improving our services. The processing of this personal data is based on our legitimate interest, which is to improve our services. Based on these analyzes, we can see where the needs of our users lie and adjust our services accordingly.

This processing of personal data therefore also benefits you. We also ensure that your fundamental rights and freedoms are respected.

  • Direct marketing and profiling

Your personal data will only be used for direct marketing purposes when DigitalHQ would have obtained your explicit prior consent for this (“opt-in”) when creating your account on our E-zie application. If you have given such consent, you can withdraw this consent at any time. If you wish to withdraw your consent for direct marketing, you can send an email to the following email address info@digitalhq.eu.

Who does DigitalHQ share this information with?

Your personal data will be kept strictly confidential and will generally not be communicated to third parties, with the exception of the provisions below.

DigitalHQ which acts as a controller can make it to the processing of personal use of other service providers. These service providers will act as processors. They may only process the personal data on our behalf. DigitalHQ has concluded a processor agreement with these processors. In this, the processor is obliged to comply with, among other things, all legal provisions and the provisions of this Privacy Statement.

Where DigitalHQ acts as processor , DigitalHQ can - subject to the consent of the controller - engage so-called sub- processors. DigitalHQ will also enter into the necessary processor agreements with these sub- processors, so that your rights as a data subject are guaranteed.

Your personal data will only be processed within the European Economic Area.

How does DigitalHQ secure this data?

DigitalHQ continuously takes appropriate technical and organizational measures to protect your personal data to prevent loss, unlawful use, and unlawful processing of your personal data by others, and also to prevent unauthorized access to your personal data. E-Zie was developed in accordance with the “privacy by design principle” by, among other things, encrypting the passwords of visitors.

How long does DigitalHQ keep this data?

DigitalHQ only stores your personal data for as long as this is necessary for the purposes described. In this way we also prevent irrelevant information from being stored. Since the contractual liability claim only expires after 10 years, we will archive certain data for this period - for this purpose only. As you can see below, you can always request us to delete certain data. DigitalHQ will always comply with this if the legal conditions are met ( see article 7).

Your rights

You have the right to inspect the personal data that DigitalHQ has about you (and to receive a copy thereof).

You have the right to correct the personal data that DigitalHQ has about you if they are incorrect or outdated and / or to have them completed if they are incomplete.

You have the right to object to the processing of your personal data where this is based on a "legitimate interest" of DigitalHQ. If DigitalHQ processes your personal data for direct marketing purposes, you do not even have to motivate such a request. If processing takes place on the basis of the consent you have provided, you always have the right to withdraw this consent.

In principle, you have the right to obtain the personal data that DigitalHQ has about you in a structured, commonly used and machine-readable form and to transfer it to another controller.

In principle, you have the right to request DigitalHQ to delete your personal data and / or account. However, you also have the right to request that the processing of your personal data is only limited (for example: making personal data inaccessible).

Amendments

DigitalHQ reserves the right to change this Privacy Statement. The changes will be announced via our E-zie application. DigitalHQ advises you to regularly view the Privacy Statement. If you do not agree with the changes, you can delete your E-zie account or request its deletion to DigitalHQ.
